Prospect Research supports the University of Tennessee’s Advancement efforts by collecting, evaluating, analyzing, organizing, and disseminating publicly-available information to UT staff.  Our goal is to enable accurate and educated decision-making.

Gift Agreements

  • For a gift agreement to be fully endowed, at least $25,000 must be pledged.
  • For a gift agreement to be accepted and booked on the Foundation’s records, it must be an executed copy. Scanned or faxed agreements are acceptable.
  • If the gift agreement states “The Donor has given” always verify on ANDI the money has been received and is posted to the donor’s ANDI record.
  • When adding to an EXISTING account, no specifications on how the money will be spent can be made in the gift agreement.

Gift Agreement Must Haves

Establishing

  1. The Donor(s) <commits/commit> $__________ to the <Name of Endowment/Scholarship/Current Fund> as indicated by <his/her signature or their signatures
  2. The gift will be used to establish the <endowment name> Endowment which will provide support (supporting) for the Department of <department name, college and campus>.
  3. The <list Dean, Director, Department Head, etc.> of the <list college or department> will determine how and how much of the annual earnings will be spent.
  4. Any program, project, or activity funded shall be subject to the policies and administrative guidelines required by the University. Any scholarship, fellowship or faculty award funded with the endowment earnings shall be open to all eligible applicants regardless of race, color, religion, sex, national origin, citizenship, disability, age, or veteran status.
  5. If it becomes impossible or impractical to use the gift for the purpose designated by this Gift Agreement, or if this Gift Agreement is determined to be in conflict with any federal, state, or local law, regulation, or ordinance, the Foundation’s Board of Directors, in consultation with the Donor(s) (if possible) or with the President of the University, will direct the use of this gift in the best interest of the University and in a manner as close as possible to the original intent of the Donor(s) as expressed in this Gift Agreement. The identity of any named funds will be retained and will always bear the name indicated by the Donor(s).
  6. The Donor(s) or other contributors may add to this endowment with gifts of cash, securities, or other assets, which, if accepted by the Foundation, will become subject to all the covenants, terms, and conditions of this Gift Agreement. However, IRS regulations preclude this pledge from being satisfied by a donor advised fund, community foundation, or family foundation.
  7. In the event gifts or the proceeds from the sale of donated securities or other property are insufficient to establish the minimum required endowment level within the specified payment schedule, the Foundation will contact the Donor(s) (if possible) to discuss an alternate use or additional contribution. If it is not possible to consult with the Donor(s), the Foundation’s Board of Directors, in consultation with the Chancellor of the University of Tennessee, Knoxville will select an alternate use or combine this gift with other funds for similar purposes, keeping in mind the original intent of the Donor(s).
  8. In grateful recognition of <name of donor(s)>’s generosity, this endowment will be known as the <name> Endowment.
  9. The Donor(s) <gives/give> the Foundation permission to publicly recognize <his/her/their> commitment. The Foundation will, however, clear any press releases with the Donor(s) before issuing such release.
  10. The Foundation may, for investment purposes, commingle the property comprising this gift with any of its investment assets; however, the gift shall be entered on the Foundation’s books and records as stated in Section II. The Foundation will invest the fund and reinvest some or all of the earnings as governed by the University of Tennessee Investment Policy. All earnings will be reinvested until the endowment principal balance reaches $25,000. Normal fees associated with the collection and disbursement of gifts and gift income may be assessed.

Adding to Existing

  2. The gift will be used to add to the existing (or add to the) <endowment name> Endowment which will provide support (or supporting) for the Department of <department name, college and campus>.

Gift Agreement FAQ

When do I need a gift agreement?

A gift agreement will be needed for any gift or pledge (endowed or non-endowed) of $25,000 or more. See attached link for a more detailed breakdown.

What qualifies as a gift and can be accepted?

See attached link for a breakdown of gifts that the UT Foundation can accept.

How many originals of a gift agreement should I submit to a donor for signature?

You should submit one (1) original to your donor for signature. After processing by Advancement Services, one (1) original (scanned and/or hard copy) will be returned to the development officer to return to the donor.

What is the procedure for gift agreements in the Foundation?

The attached link provides a detailed step by step guide for the gift agreement process.

What if the donor requests multiple originals back, say, for other family members?

You may submit more than one (1) original. When you return multiple originals to Advancement Services for signature and processing, please include instructions to return additional originals to you for the donor(s).

Where should I send my gift agreement for review?

Send all drafts to prospect@utfi.org. Your drafts will be reviewed and approved and sent back to you within 24 business hours.

Where should I send my signed gift agreements for processing?

Send all signed gift agreements to Advancement Services for processing.

Why do my gift agreements need prior review and approval?

The Advancement Services Staff will review your gift agreements for consistency and policy compliance.

What if I can’t find a gift agreement template that fits my donor’s request and needs?

Contact prospect@utfi.org for guidance.

Can I include a payment schedule for more than 5 years in a gift agreement?

Yes, as of right now you can. Once a new campaign begins, all gift agreements of more than 5 years will have to be approved by the Gift Acceptance Committee.
